SNF found not guilty for resident death, but must pay for pain and suffering

Christine Mitchell, a SNF resident, suffered a brain injury following a fall when an aide rolled her off her bed. Mitchell has already been in poor health when she died a month after the fall in 2015.

Although the jury did not find the nursing home,  Grace Healthcare of Tucker located in Tucker, GA,  responsible for Mitchell’s death, they did did find the skilled nursing facility liable for Mitchell’s pain and suffering in her final days, and awarded the victim’s family $1.8 million.

“Hopefully this verdict is part of a process that says enough is enough — don’t do this to our loved ones, they deserve more,” said Evan W. Jones, one of the attorneys representing the family told AJC. A lawyer for the SNF told AJC they were considering options for an appeal. Grace Healthcare of Tucker is a 136-bed for-profit facility part of a larger, 30-facility chain.
