Vaccinations and HIPAA

Our hospital has written a new policy regarding mandatory vaccinations for seasonal flu vaccine and H1N1 vaccine.  If we do not comply, we will be required to wear a mask on hospital property (even if we are healthy and well ) until flu season is over.

For various reasons I am choosing not to be vaccinated which, to me,  is a personal and private matter. I do not work in a patient care area, and if I am forced to wear a mask it will be known to others that I did not get vaccinated, something I do not care to share with other employees.

Can this be considered a HIPAA violation?

    It is no more a HIPAA violation that it would be for those who are not wearing masks which is signifying they did receive the mandated H1N1 and seasonal vaccinations.

    This is more rooted in HR policy with a relationship to conditions of employment for your organization.
